Welcome to our games and related services (the “Service”). These Terms of Service (“Terms”) describe your rights and obligations when downloading, accessing, creating an account for, or otherwise using the Service provided by YsGames Co., Ltd. (“Company,” “we,” “us,” or “our”). By downloading, accessing, creating an account for, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Definitions
- Service: Our games and any related features, websites, apps, content, virtual items, in-game communications, and customer support provided across mobile, PC, tablet, TV, console, or other devices.
- User / You: Any person who accesses or uses the Service.
- Guest Account: An account that is not linked to an external identity provider or that lacks full verification; Guest Accounts may have limited persistence.
- Virtual Items: In-game currencies, items, characters, skins, passes, consumables, or similar digital content to be used within the Service.
2. Changes to These Terms
We may change these Terms from time to time to reflect changes to the Service or applicable laws. When we make material changes, we will post the updated Terms in-app or on our website and indicate the Effective Date. If you continue to use the Service after the Effective Date, you accept the updated Terms. If you do not agree with updated Terms, you must stop using the Service and may request account deletion as described in our Privacy Policy.
3. Other Policies
Our Privacy Policy describes how we collect, use, disclose, and retain personal data and includes information about your rights (for example, GDPR/CCPA rights). Additional policies such as community rules, moderation policies, and safety guidelines may apply and are incorporated by reference.
4. Eligibility & Accounts
- Eligibility: You must be old enough under local law to use the Service. If local law requires parental or guardian consent for users below a certain age, that consent is required before such persons may use the Service.
- Guest Accounts: Guest Accounts may be lost if you change or reset your device, uninstall the app, or clear certain data. We do not guarantee recovery for Guest Accounts.
- Account Security: You are responsible for activity under your account and for maintaining the confidentiality of your credentials. Notify us immediately of any unauthorized access.
- Verification: For certain actions (e.g., refund investigations, purchases), we may require proof of account ownership or identity verification.
5. User Obligations (Prohibited Conduct)
You agree not to:
- Provide false or misleading information or impersonate others.
- Violate intellectual property, privacy, or other rights of third parties.
- Use cheats, bots, automation, exploits, or unauthorized third-party software.
- Buy, sell, transfer, gift, or otherwise commercialize accounts or Virtual Items outside of features we explicitly provide.
- Harass, threaten, defame, or otherwise harm other users or post illegal, obscene, or hateful content.
- Interfere with the Service’s security, servers, or network operations.
- Use the Service for commercial advertising, political campaigning, or illegal activities.
Violations may result in warnings, content removal, feature limits, temporary suspension, or permanent termination of access.
6. Service Content, Updates & Balancing
The Service is a creative, virtual environment that the Company controls. We may modify, update, add, or remove features, content, events, or Virtual Items for balance, security, technical, or business reasons. We may deploy emergency patches or fixes without prior notice. Where feasible, we will provide notice for significant changes via in-app messages or our website.
7. Availability & Downtime
We aim to provide continuous service but do not guarantee uninterrupted operation. The Service may be unavailable for maintenance, security reasons, technical failures, or events beyond our control (including force majeure). For planned shutdowns or termination of a major feature or the Service, we will provide advance notice where feasible.
8. Notices & Communications
We may send you notices via in-app messages, push notifications, email, or other reasonable methods. Notices to the Company should be sent to ysgames.cs@gmail.com unless specified otherwise. You agree that such methods constitute valid notice.
9. Purchases, Fees & Taxes
- In-App Purchases: The Service may offer paid features and Virtual Items (“Premium Services”). Prices and availability vary by platform and region. Purchases are processed by the platform provider (e.g., Apple App Store, Google Play) or our payment partners.
- Taxes/Fees: Prices may exclude applicable taxes, fees, carrier data charges, or currency conversion costs imposed by third parties.
10. Virtual Items; License; Expiration
- You receive a limited, personal, revocable, non-transferable, non-sublicensable license to use Virtual Items only within the Service.
- No Cash Value: Virtual Items have no real-world monetary value and are not redeemable for cash, except as required by applicable law. To the maximum extent permitted by law, Virtual Items are non-refundable.
- We may modify, limit, suspend, or remove Virtual Items (including free items) for gameplay balance, security, or operational reasons. Time-limited Virtual Items expire as shown at the time of acquisition; unless otherwise stated, time-limited items expire 365 days after purchase.
- Regional consumer protections prevail where they provide greater rights.
11. Refunds, Withdrawals & Unauthorized Purchases
- Platform Rules: Refunds generally follow the platform provider’s policies and applicable consumer laws. If you purchased via a platform, please check the platform’s refund rules first.
- EU/UK Withdrawal Right: If you are in the EU/UK, you may have a statutory right to withdraw from purchases of digital content within 14 days unless you consent to immediate delivery and acknowledge that you lose the right to withdraw once delivery begins.
- Unauthorized Transactions: For suspected unauthorized purchases, we may require reasonable proof (e.g., device/account verification, parental consent proof for minors) to evaluate refund requests. Abuse of refunds/chargebacks may result in account actions.
12. Minors & Parental Controls
If you are a minor under local law, you represent that a parent or legal guardian has reviewed and approved your use of the Service and any purchases. We may require verification of parental consent for minors and may restrict certain features for under-age users.
13. Intellectual Property
- The Service, including software, artwork, music, text, logos, and trademarks, is owned by the Company or our licensors and protected by law.
- You may not copy, distribute, publicly perform, or create derivative works from the Service except as expressly permitted.
- User Content: If you submit content (e.g., chat messages, screenshots, feedback), you grant us a worldwide, perpetual (to the extent necessary for operation), royalty-free, non-exclusive license to host, store, reproduce, modify, publish, and display such content to operate, moderate, and improve the Service and for safety and legal compliance. We will not sell your User Content for third-party marketing.
- We may remove content that violates these Terms or applicable law.
14. Advertising & Third-Party Services
The Service may include ads or links to third-party services. Third-party services are governed by their own policies, and we are not responsible for those services except as required by law. You may be able to opt out of marketing communications as described in the Privacy Policy.
15. Enforcement; Moderation; Suspension & Termination
We may limit features, suspend, or terminate access to the Service for users who violate these Terms, engage in fraud, or pose security risks. We will notify you of enforcement actions when feasible and provide an opportunity to appeal via in-app support or email. Termination for cause may result in forfeiture of Virtual Items, and payments are non-refundable except as required by law.
16. Appeals & Player Support
If we take adverse action on your account, you may appeal using the in-app support system or by emailing ysgames.cs@gmail.com. Please include your user ID, device model/OS, purchase receipts (if relevant), and a detailed description. We aim to respond within a reasonable time (typically up to 14 business days), though response times may vary.
17. Disclaimers; Limitation of Liability
- No Warranties: The Service is provided “AS IS” and “AS AVAILABLE.” We disclaim all implied warranties to the fullest extent permitted by law.
- Limitation of Liability: To the maximum extent permitted by law, the Company and its affiliates will not be liable for indirect, incidental, special, punitive, or consequential damages arising out of or related to the Service. Our aggregate liability for claims arising out of or relating to the Service will not exceed the greater of (a) the total amounts you paid to the Company for the Service during the six (6) months preceding the claim, or (b) USD 100, except where such limitations are prohibited by applicable law.
- These limitations do not apply to liability for intentional misconduct, gross negligence, or as otherwise required by mandatory local law.
18. Indemnification
You agree to indemnify and hold the Company, its officers, directors, employees, agents, and affiliates harmless from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of third-party rights.
19. Copyright Policy (DMCA / Takedown)
If you believe content on the Service infringes your copyright, provide notice containing: (i) identification of the copyrighted work; (ii) identification of the infringing material and its location; (iii) your contact details; (iv) a statement under penalty of perjury that the information is accurate; and (v) your physical or electronic signature. Send notices to ysgames.cs@gmail.com. We will respond to valid notices in accordance with applicable law.
20. Governing Law; Dispute Resolution; Consumer Rights
- Local Consumer Protections: Nothing in these Terms limits rights you have under non-waivable local consumer laws.
- EU/UK Users: If you reside in the EU/UK, you may bring legal proceedings in your local courts, and your local mandatory consumer protection laws apply.
- Other Regions: Except as required by local mandatory law, these Terms are governed by the laws of the Republic of Korea, and disputes may be brought in the courts of Seoul, Republic of Korea.
21. Termination by You; Data Deletion
You may stop using the Service at any time. To delete your account or request data deletion, follow the in-app process or contact us at ysgames.cs@gmail.com. We will process data deletion requests in accordance with our Privacy Policy and applicable law. Account deletion may be irreversible and may cause loss of Virtual Items.
22. Force Majeure
We are not liable for failures or delays caused by events beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, internet or utility failures, changes in law, or platform policy changes.
23. Severability; Assignment; Entire Agreement; Survival
- If any provision of these Terms is held unenforceable, the remainder of the Terms remains in effect.
- You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms to an affiliate or in connection with a merger, acquisition, or asset transfer.
- These Terms, together with the Privacy Policy and any other incorporated policies, constitute the entire agreement between you and the Company regarding the Service.
- Provisions that by their nature should survive termination (e.g., Intellectual Property, Indemnification, Limitation of Liability, Governing Law) will survive termination.
